The case focuses the attention of the Buenos Aires coastal city not only because of the economic value of the property in question, but because it calls into question the validity of an administrative and legislative process that took months of debate and that, days before its culmination, was halted by the justice system.
A long previous process: from the Deliberative Council to the auction date
The history of the Necochea Casino Complex as a property to be auctioned did not begin in February. The process originated in an extensive debate within the local Deliberative Council, the city’s legislative body, which at the time had to analyze the convenience and legality of putting the property up for sale through a public auction.
After several instances of political and administrative discussion, the Council approved the sale of the property by majority and passed the ordinance that enabled the procedure. With that legislative support, the municipal Executive moved forward with the organization of the auction and set February 11 as the date for its realization.

The appeal filed by the Municipality implies that the file will be sent to the Administrative Litigation Court of Appeals of Mar del Plata, the second-instance court with jurisdiction to review the resolutions of the local court.
The Chamber will have a precise task before it: to analyze the appeal presented by the municipal Executive, examine the grounds for the first-instance decision that maintained the injunction, and determine if the irregularities identified by the court are sufficient to sustain the suspension or if, on the contrary, it is appropriate to lift the judicial halt and allow the auction to proceed.

Beyond the particularities of the case, the situation of the Necochea Casino Complex illustrates a tension that is frequently repeated in the municipal management of public assets in Argentina. In this case, the court did not question the Municipality’s authority to auction the property nor the political decision of the Deliberative Council to approve it, but rather the way in which that process was instructed. A distinction that, while seemingly technical, has enormous practical consequences for the local administration and for potential parties interested in participating in the auction.
While the Mar del Plata Court of Appeals defines its position, the Necochea Casino Complex remains in a legal limbo whose resolution will mark the course of one of the most closely followed public asset sale processes in the Buenos Aires region in recent months.
